Essentially, Baird gave too much in sanctions to Scientology, and Ken was right in refusing to [let Liebreich] answer a number of the questions for which he [and Liebreich were] sanctioned, so the Baird court must recalculate the sanctions in a reasonable manner. It was not reasonable for the Baird court to charge for transporting Sandy Rosen first class to Florida to take an abusive deposition. Therefore they only get paid for the actual motion to compel, not the deposition itself, and not the unreasonable cost of transporting Sandy Rosen from New York to Florida and back.
